High Court bans Labors Malaysian Boat People “solution”

No Australians voted for this “Malaysia solution”. Most Australians believed it to be ridiculous, and the High Court of Australia shares our opinion. After months of international condemnation, the High Court has temporarily ruled that the Government is breaching the International laws on human rights with the attempt to send 42 helpless people including minors back to a life of degradation and torture.

These are strange times when our courts appear to be far more rational and open armed than our Government.

Judge Kenneth Hayne said that the Governements legal team where “unprepared” for the court hearing saying their arguments were “half baked”.

Immigration Minister, Chris Bowen played down the ruling, and this highlights  the most embarrassing debacle for the Gillard Government which is still suffering from the toxicity of the Carbon tax fallout. Minister Bowen admits  that now Australia gets 4,000 refugees from Malysia without sending a single person in return. How can we trust a Government who continually fails with their Policy?  The new Asylym Seekers could wait for up to six months before their cases are heard causing further grid-lock for over 90,000 other refugees in detention centres around the Country.

Justice Kenneth Hayne said, “There are serious questions to be asked over whether the human rights of asylum seekers sent to Malaysia could be upheld.”

Liberal immigration spokesman Scott Morrison  said, “Once again chaos continues with Labors asylum policy”

The case will be heard in Canberra and could cost the Government several hundred thousand dollars in legal fees and related costs. The High court’s Full Bench will hear the Governments legal challenge on August 22.

With all the issues modern Australians face, with the stock markets teetering and economies failing we find our bureaucrats bickering about a ridiculous piece of policy that won’t benefit Australians or any humans. You can’t help but wonder, who are these people creating our laws?

What a waste.

    Actually all this says is that the courts care about upholding the law. The Malaysia solution was clearly illegal and the Labor government have lost the plot when they were attempting to push through a plan that would have violated international treaties that we’ve ratified.

    Very good point, Jason. I’m proud of the High courts decision I feel it gives them a lot of credibility and even a little bit more humanity. I’m glad that somebody has finally said enough, whether it be apart their mandate to do so or not. It does take guts to take this stance and I hope that this embarrasses the hell out of the Government. I wish I could have been in that courtroom…

      I never thought “boat people” was a problem worthy of our nation’s time especially given the bigger global shit going down around us. But this leaves a track record of, oh… close to 100% of Julia Gillards promises, a fruitless waste of time, money and energy.

        I keep hearing that Julia is this shrewd politician but I just haven’t seen it. From what I can tell she’s got the Labor Party wrapped around her finger but she’s successfully alienated both the left and the right of Australian society. Every time she says, “It’s only an opinion poll” I feel like yelling at her, “And if it said you were popular you would have said, ‘it’s proof the government are doing a fantastic job!’ You can’t have it both ways you stupid cow!” Not to even mention that she *had* to get rid of Rudd because the polls said he was unpopular, the polls say he’s far more popular than she is.

        You’re right Bitto, the boat people issue is tiny compared to other problems the media aren’t even touching. It’s a political smokescreen.

          Julia’s government being this shit isn’t exactly her fault. After all, we did vote in a hung parliament, and people forget she is no one’s leader. She’s a puppet who has to keep the MPs happy: the independents, the greens… a lot of her purely-Labor ideas could never happen because it’d fragment the government. She has had to adopt policies and back them as her own with a huge public smile and encouraging words. I am sure the Carbon Tax resurrected because of this situation inside the caucus. But either way, it’s a government that’s not working and she has to go.
